Hi,

I have been told by a colleague of someone she knows who is having a problem with their work.

The guy wears hearing aids and pretty much cant hear anything without them.

His employer is making him remove his hearing aids and wear hearing protection during work time, which leaves him unable to hear anything at all.

He has asked for ear muff type protection, which they supplied, but they still force him to remove his hearing aids when wearing the ear muffs!

His work area has also been changed to make him safer. He has been moved further away from where the FLT is used!

He is a foreign worker (on a zero hour contract I assume) and is worried that he will get sacked if he kicks up too much of a fuss.

Surely his employer is wrong to force him to remove his hearing aids?

The irony of him removing his hearing aids to wear ear defenders to protect his hearing is completely understated.

I don't know on which side of the fence I would sit with this. I have to say that in our place he would probably be subject to an individual risk assessment, but if the noise level is over 85dB(A) then the employer's hands are tied and he may have to remove his hearing aids to ensure the correct fit of the ear defenders which are mandatory.

Unfortunately the law doesn't necessarily allow for these anomalies, and his employers seem to be doing as much as they can to ensure his safety while still working within the law.

Everywhere you look, big or small businesses we have the same this when it comes to noise at work:

blanket ear defenders for all and then totally ignore the regulations that state that noise should be reduced to the lowest level.

FYI --- his hearing aids will not work under ear defenders (muffs) as the proximity to the aid will cause feedback.
