Hello, We have a waste compactor which is manually operated and not guarded. We are looking at this to be repaired and a company has mentioned that we are not complying with PUWER legislation as this is not guarded. The access to the bin itself is not accessible to employees (too high). For them to access this they would need a lifting equipment or a ladder. For injury to occur another operator would need to have his finger on the control still. Does this still require guarding? Thanks for your opinions Katie

Katie, Yes & no! Sorry... More information and details would be required. Your PUWER assessment should have shown up any requirement for guarding when it was done, so if, your assessment is OK< then the repairers are wrong. If you haven't done one, then, you may well need to do one. There are external companies and individuals that can help, with both the assessment and guidance.
