Hi, I'm after some advice.
I know that smoking outside doors etc is not illegal, but I work in a warehouse with a big roller shutter door and the smokers gather outside the door.
I am not a smoker, but I work at the area of the door as I'm goods in, I often have the smoke coming into the building, which I am breathing in and causing me chest pains due to my asthma.
Do I have a right to request the company to move the smokers elsewhere and does the company have to take notice, as I am breathing in the second hand smoke while I'm carrying out my duties of work.

Hi George
First of all check out your company's smoking policy, your HR or HS department should be able to provide one for you. Or check out your employee handbook it should have a section under smoking.
Most Company's do provide areas specifically for smokers to use and don't allow smoking anywhere else on the company premises.
At my own company we have specific smoking areas and smoking is not allowed anywhere else; that also includes external areas such as car parks, vehicle yards etc that are owned by the company.
So check out your company's smoking policy.

Smoking areas must be designated and away from the 'general workforce' - also, if this entrance is used for moving goods in, then that area must be kept clear as to prevent vehicles colliding with those using it as a smoking area.
