Good morning, on a recent post of mine, someone commented regarding the (secondary) effect to my query regarding the 'removal of strict liability' on employers. Personally I think I may have missed this removal as the last I'd heard, I though that notion had been defeated in the 'Commons'. Can anyone clarify for me, particularly with regards a reliable source, as to the status of Strict Liability within H&S management please? Thanks in advance

Seasons greetings, Adale That would be Section 69 of the Enterprise and Regulatory Reform Act 2013. Check it out on legislation.gov.uk A diabolical misstep: from my perspective we need every opportunity to prosecute these OHS criminals. The clue is in the word reform in the Act's title. It's merely [sic] further assistance to the Tories business mates together with making claims in the Employment Tribunals extremely difficult So, essentially, you can no longer sue for breach of statutory duty under OHS; only for the forensic lottery of negligence.
