Hi Ian I believe these sentencing guidelines will be applied from the 1st of February and will apply to all health and safety, food safety and corporate manslaughter cases heard irrespective of when the offence occurred.

It will be interesting to see if this change actually delivers an increase in custodial sentences for individuals as predicted. It will also be interesting to see how high fines will actually be for very large undertakings.

This was also discussed in the forums when the guidelines were published and there ha s been a huge amount of articles on it in the SHP and other Health & Safety and Law Magazines etc.
