I have tried to use the search function but I am having no joy.

I have had an accident reported where a member of staff has tripped on a local car park, on the way into a customer site, this has resulted in a broken metatarsal and 36 days off sick.

Would this be RIDDOR reportable?

36!!! days off work for a broken toe? What kind of job are they doing that they felt they could not come to work with one of these modern casks?

I have recently broken a metatarsal myself and was back up on my feet within a week, albeit with pain?

On the RIDDOR issue: Was the individual at work? Did you pay him for his time in the local car park? Was this commuting to his usual place of work?

2. Was it work-related? Unknown.
3. Did it result in a reportable injury? Yes.


Too often focus is on the injury and the fact that an accident occurred a. at a workplace or b. in work time. These are part of the consideration but not the totality. An accident is ‘work-related’ if any of the following played a significant role:

the way the work was carried out
any machinery, plant, substances or equipment used for the work or
the condition of the site or premises where the accident happened


To put it in perspective...if a typically healthy individual trips over their own feet whilst on a well lit, good condition surface then this is most likely not going to be RIDDOR reportable. Conversely if the business knows that this car park is going to be used, that it is in a terrible state or that the person has mobility issues and needs assistance etc. then this pushes towards it being reportable.
Those are extremes that help frame the point. Each accident will have its own situation and event timeline that should factor into the decision concerning item 2 above.

There is arguably not enough information in your post to make any kind of conclusive decision.

Thank you for your responses.

I unfortunately was not at work at the time and am now only just picking this up.

Based on what you have said I am going to safely assume that this is not reportable.

Cdc, I know 36 days is ridiculous but what can we do!

I fractured my 5th metatarsal on my right foot a couple of years ago. Two weeks in plaster and three/four weeks in a surgical boot is the norm. I was advised not to drive because it was my right foot (braking foot) so being incapacitated for 36 days seems about right.

'specified injury' would be more appropriate.
