Hello, I am after some advice please.... A utilities company laid new cabling across a public path and into a private property I went to speak to them an advised I was worried about this not for another reason than falling over the caballing or twisting there ankle on the small opening on the public path way. The property owner came out and was also worried with regards to his standing as if someone fell over the cabal running across his garden he was then liable........ I wasn't sure on any of this so thought id ask the kind people of IOSH for some advice I can pass on :) Thank you

Hi I presume this was a temporary arrangement prior to burying the cable underground? In the situation you have described the responsibility for any injuries caused would lie with the utility company. They have a duty to ensure no one is injured as a result of their work. Where practicable, the cabling should have been protected in a sheath, identified with hi-visibilty tape, or the area demarcated with barriers to ensure no one tripped over it. Good supervision is the key, in the real world this often does not happen.
