Hi there.

I am a German of South African origin and now working in Germany for an international company.

Does anyone have any experience with gathering injury statistics (including lost time injury rates) here in Germany? I am constantly being given the excuse by some sites that they are not permitted to release that information due to data protection rules here, and yet other sites are perfectly willing and able to do so. This is often the case when asking about how much occupational sick leave was given, how much time was lost etc.

Does anyone per chance have any specific reference material regarding this? Or experience in dealing with this? English is actually my first language with German as a 4th language. Although my German is not bad, most of the legislation is exclusively available in German (understandably so).

I don't know much about German legislation specifically I am afraid,but data protection in the form I am aware of is all about protecting personal data and specific details of individuals.

If you are asking for numbers of absences and how long for statistics then providing you are not asking the names, etc. of the specific individuals I can imagine that it would be a problem. Especially as you have a valid reason for wanting the data.

Likewise, I am not an expert on Data Protection, but my understanding is that the current legislation was brought in as a European Regulation so German law should be exactly the same as in the UK. Although I am aware you may not have much experience of the UK law, it does mean you should be able to find an English version to read.
In any case the advise at #2 should be correct.

Hi Dieters7,

I work in the UK but have responsibilities for sites in Germany also. Most of the legislation is available in English but it's very well hidden. when you mention sites, are you referring to sites run by your employer?

It depends what statistics you are looking for. If you are looking for individual case studies, I can understand why the employer would not wish to release the information. On a more general note, the information for a particular trade or occupation will be held by the statutory insurance organisation for that trade or organisation (Berufsgenossenschaft). Some of them are prepared to make overall statistics available. In addition the general association of insurance providers (Berufsgenossenschaftverband) does usually publish statistics, but usually only in German. These are usually broken down into individual trades and are quite detailed. For example I have one that shows that occupational skin disease represents 34.7% of all recognised cases of occupational ill health and is then divided into the different industrial/occupational sectors.
I cannot comment on other areas, but for example the technical regulation for hazardous substances (Technische Regel fuer Gefahrstoffe) no. 401 is available on line in English.

Yes, I am referring to our own sites in Germany. To cut to the point, I am trying to see if the are not gathering (or releasing) about Lost Time Injuries because they; a) don't have it b) have it but wont give it to me (?) c) don't want to gather the info regulary or d) have no idea what I need!
