Small building company 17 operatives plus admin and managers are working for a National facilities management /maintenance company, who sub-contract work on to us. Who is the PC ? Do they complete the Construction Phase Plan or ourselves ?
They have never asked us for a phase plan and we have never seen one of theirs for any works undertaken on their behalf .

You are the PC (ask for a letter of appointment), they provide the PCI you complete the CPP on the back of the PCI.........bingo

Under CDM it is the Client who appoints the PC (and PD). So without any information to the contrary it is the National facilities management /maintenance company who are the PC, who of coure should have been appointed by the Client. Furthermore, it is the PD who provides the PCI from the Client, not the PC.

Most of the work is responsive maintenance so we get no PCI.
Usually only on-site a day or two for each job, or a few hrs.

We taken legal advice on PPM and reactive 'maintenance'
CDM talks about 'principles of prevention' to that end we have reviewed RAMS and so long as it's a single contractor (or internal work) and the contractor has had comprehensive site rules/ induction we are working under the 'principles of prevention'.
We await test cases I suppose BUT at the same time are comfortable that we are working in a safe an compliant (hmmm) manner

If the client doesn't appoint a PC or PD in writing they take on the roles.

It is Principal Contractor......
...it bugs me as it also does when people refer to the Construction (Design and Maintenance) Regulations 2015 (CDM 2015) or refer to the CDM Co-ordinator under CDM 2015 or even Designers Risk Assessments. Just saying!

Some very presumptive responses here!
That National FM/ maintenance company may be undertaking the role of Principal Contractor for any number of Clients, making you a contractor in the context of CDM Regs.
Your Contract terms should clarify. If in doubt, ask those who appoint you - the answer isn't on this Forum. As others allude, a lot of reactive routine maintenance activity is not affected by CDM - a point that was made very clear in CDM 2007, in 2015 less so.
