We have an employee who has worked with vibrating tools for 46 years, 4 to 5 years ago he experienced HAVS problems. Didnt declare in his pre employment medical questionairre as the questions were not specific enough, he has worked with us since June 15. He has undergone Occ Health assessment and Consultant Physician impression is Sensorineural HAVS which would be reportable. I believe I have to report the RIDDOR but just checking opinions here as he didnt contract HAVS with us.

Yes I think it is one that requires reporting.

Steve, Just check, but i think because its an ongoing medicical Condition which he failed to declare, That on its merits would not be normally reportable as its not your compnay which caused him to have the condition in the first place.

 The problem with HAVS is that its a long term problem, Working for 5 Years for you, with reasonable risks assessed and documented would not of cause him to Sensorineural HAVS. I trusting you have documented Health survielance at your company??

You say

id he didn't declare in his Pre Employment Medial Questionaire as it was not specific enough??? If you ask him in the questionaire if he has any previous medical condition to list them and he hasn't then to me thats specific enough.

Perhaps you could quote the section from your questionaire about previous medical conditions?
