Hi. We recently suffered partial wall collapse in work, in which drainage works were being carried out in close proximity to a building wall. The excavator jib made contact with the thermal block wall, causing a number of the blocks to fall inwards. No one was injured however I am uncertain if this is reportable under RIDDOR as a dangerous occurrence, the wording is not clear as it reads that the collapse must be linked to on-going construction work, is this referring to construction work for the building itself or nearby works such as drainage?

Hi Graeme,
HSE states that you should use the definition in CDM 2015 to decide whether what you are doing is construction work. If you look at Reg 2, you will see the definitions. Hence, if your work is covered under CDM 2015, I think you need to report it. Specifically, excavations and ground works for a structure are included in CDM 2015 and a structure includes any pipe or pipeline (follow through all the definitions section). I think you need to report it.

Reportable in my book - the activity you describe in "construction work" within the meaning of CDM.
Key words in RIDDOR are "arising from , or in connection with, ongoing construction work".
Partial wall collapse arising from construction work.

Can I just clarify that this was your appointed contractor, undertaking works on your premises, on your behalf?

I'd take the CDM defintion of construction work and see this as reportable in my book.
