Poor worker. This looks like a serious multitude of neglegent acts that has led to yet another preventable accident. I hope that companies are seeing the recent prosecutions by the HSE and they act to comply with legislation. Thank you for the post.

Extract from the press release:

"An investigation by the Health and Safety Executive (HSE) found the company director did not ensure the burning of the waste material was being carried out in a safe or appropriate manner."

That is not quite right either, because it is illegal to burn your own commercial waste without an exemption, unless it is in a very small range of waste (bark, untreated saw dust, plant tissue). So, it was not just it being carried out in a safe manner, but should not have been doing it anyway safely or not.

A further example of HSE shutting stable doors.

If HSE had sufficent field inspectors out there, jumping on cowboys (big and small) before the event then less folks would die and be maimed. Also the playing field would be levelled for the companies who try to look after their people.

25 years ago, the factory I worked in could expect an unannounced visit every year.

The worst aspect of this case is the director failing to administer first aid or take the IP to hospital. The report does not suggest whether the waste burning practice was a one-off or common practice. Nor does the report state whether the director was banned from being a director, which I believe would have been commensurate punishment.

He will serve 2-3 months, his wife will become director (in name only), he will carry on undercutting his competition who have some morals and are behaving.

HSE will "show surprise" when his actions maim another poor sap.    

HSE will continue to divert time & money, moving goalposts and manipulating statistics to demonstrate year on year improvements.

Cynical moi?

He will serve 6 months. 1/3rd remission. Parole not available under 18 months.
