Sorry have I mis-understood something here abut RIDDOR please, is it now the case that Saturdays, Sundays, and Bank Holidays are no longer counted when considering 7 days or more lost time periods??

As far as I can see there is no change as the regs state  "7 consecutive days" and do not mention working days.

According to the amendment regulations;

The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013
5.
—(1) The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013 are amended as follows.
(2) In regulation 2(1) (interpretation), at the appropriate place insert—
“working day” means any day other than a Saturday, a Sunday, Christmas Day, Good Friday or a day which is a bank holiday under the Banking and Financial Dealings Act 1971 in any part of Great Britain;”.

The only mention of the words working day is found in the regulation, interpretation where it has :

“consecutive days” includes any days which are not or would not have been working days;

So they are clarifying that those particular days noted are to be counted ( I guess some people who like to avoid RIDDOR have been using the excuse I didn’t think bank holidays etc counted!)

Searched RIDDOR and that is the only instance it is noted in the Reg

Yes but this just affects the definitions in the regs. Reg 4 (2) is the one that defines the 7 day rule. That states "Where any person at work is incapacitated for routine work for more than seven consecutive days...". "Consecutive days" is defined by  “consecutive days” includes any days which are not or would not have been working days;" so i don't it affects this

Ok it must be Friday my head is spinning reading this! Must have been written by a Politian, Try telling the emergency services that Sunday, Christmas Day etc. are not working days!

In terms or over 7 day injury I don’t think it makes any difference –it just means that you count these days even if they would not be working days, which was always the case! Totally unneeded change in legislation!

Thanks all for a comprehensive response. Though my head is only spinning slightly slower. I am familiar with the 7 consecutive day rules and the requirement to count Saturdays and Bank Holidays etc.

I'm still confused about what has been amended if anything at all?

Can anyone clarify this for me please?

I think that the riddor update is just to give clear definition, as somewhere along the line im sure someone has been able to argue a case around the wording in question.

RIDDOR seems to have no major changes (mainly further definition of single reports for multiple cases)
