Please can someone advise if RIDDOR applies in Jersey if the parent company is based in the UK?

I work for a healthcare provider who has care homes in Jersey however, the company house is based in the UK.

I have done some research and it appears that Jersey is regulated by the Health and Safety Inspectorate and The Health and Safety at Work (Jersey) Law, 1989.

Thanks in advance.

Hi Mrs Noodles,

Jersey is not part of the UK and is an independent Crown territory, rather like the Isle of Man, so UK H&S law, including RIDDOR, does not apply. Jersey law does not require accidents to be reported to the local enforcers. There is also no obligation to report incidents in Jersey to the HSE even if your organisation is incorporated in the UK, as HSE has no jurisdiction on the island (though they might well be interested in the degree of control exercised from the UK). We have several premises on the Channel Islands, and we follow UK standards where they are higher than the local ones. But we wouldn't file a RIDDOR report even if an applicable incident was to happen,

John
