I would say that the responsible person is that person who is in control of the facilities and premises. The Order states that it's the employer, if the premises are under his control.
In practical terms, it's often a shared responsibility.

I would add the person undertaking the FRA must be able to ensure that any remedial work identified in the FRA is carried out, otherwise it could be argued they are not the 'responsible person'.
