I agree with the judge, how may people say they have only had a couple of drinks when something goes wrong.

It doesn't beggar belief that he did it, I understand why he tried.  However, he did step on to a decorative part of the building that was out of bounds for hotel guests and had no official person access to it.  When it gave was and he fell, it was entirely of his own making.  To go to court once and try to sue the travel operator because he made a cracking error of judgment is one thing but having had it rejected to then go to the Court of Appeal is ridiculous.  If there was access to this part of the building facade then fair enough but there wasn't.  I think I'd be too embarrassed to go to court the first time let alone appeal the decision.
