Hello all, I'd like to understand any other sources of law requiring consultation outside of H&S legialtion. I'm more than familiar with the 1977 / 1996 Regulations in our arena. But are there other equivalents in such as employment law? The term Stewards is preferred in some areas, and when H&S skills, knowledge and experience isn't as much priority as other agenda, I question the effectiveness and applicablility of representatives in terms of improving H&S performance. This is not a political debate, I have less than nothing against unions, please find another outlet if this query has instigated a strong response not related to the question I posed. I'm 'Solutions focussed' and have plans to improve the situation including their involvement. I've received unwarranted criticism on here which (IMO) defeats the purpose of this valuable forum resource.
My question is simple, and if my intent seems ambigous I'll try to be clearer. Our Regulations (SRSCR/HSCER) outline duties and functions under H&S law. If Safety Representatives have demonstrable poor attitudes towards H&S, to appoint of deteriorating H&S performance, does an organisation have to recognise them in H&S plans etc.? You can only train & coach those who want to be trained & coached right(?). I look forward to some positive responses from problem solvers with rich experience. I still love the learning curve.

ACAS do courses and have an advice line, which would be a resource to utilise on the law and HR side of consultation. Their courses are good and people are knowledgeable. (we don't know where you are, but if can get to the offices, they will have time within the courses for discussion, and it may provide a mechanism for getting people together to discuss what you want to do. http://www.acas.org.uk/index.aspx?articleid=2042
sometimes, I have found the getting of people together to watch something i.e. mock trial/tribunal is good for relationship building and discussing outside of the subject area (your sites), prior to getting onto what people want to discuss, especially seeing from other people's perspectives, similar to video by sgb access "In the real world."
however it would be sensible to put effort into choosing the attendees on the different days to attend not create a them vs us discussion, although there needs to be some mixing as all attending same course but on different dates.
it may be sensible to ask for a diagnostic chat with them about bespoke courses or done on your site, so that you can get an understanding of what you want covered, and how it would go.
