Hi all

I'm in dispute with a Principal Contractor with regards the definition of "reasonable distance" and "readily accessible / suitable place".

He thinks a reasonable distance to access enough welfare for all on site is 3miles (which takes 20 mins).

Has anyone had a similar experiance and did antone ever find a better guide than "reasonable"?

Invite them to site, treat them to some nice spicy foods then see if they think a 3 mile journey is reasonable to access the toilet

I had a similar issue with a PM once who thought welfare facilities five minutes from the worksite was ok. Until I explained the five minutes was by vehicle! 

Can't think of anything to support your case which you probably don't know already. Schedule 2 of CDM states:

1.— (1) Suitable and sufficient sanitary conveniences must be provided or made available at readily accessible places.

The definition of reasonable will always be tricky but in this case its very easy to see that a 20min drive to a toilet is far from reasonable.  Bring them site give them a gallon of strong coffee to drink and see if they think its a reasonable distance.  At the risk of being branded sexist I have to say that only a man would think it reasonable to drive 20mins to a toilet!!

What provision is in place or those that either dont drive or dont have access to a vehicle?  Are they expected to walk 3 miles?

The Crossrail boys had a similar issue, which resulted in them walking out, The further they got into the tunnel the futrther they had to walk to access toilets. 

The fact of the matter is clear, you make workers walk a long way to access toilets then you will always get workers going to the look near to where they work, I've seen instances wher we had to lift up some raised flooring in an office fitout because we suspected sewage was leaking from somewhere, what i found was an empty gallon paint tin filled with Pee and it stunk the place down.

Theres no excuse not to put Porta Loos or wash basins nearer to where the job is without the worker having to walk miles to get to the loo

Reasonable? When you consider the next town / village is going to be about 3 miles away, no reasonable person should think that appropriate. 

Are these people who think it ok, likely to have more than 1 WC in their own home ?
