I understand all commercial properties must have an asbestos register but how does this rule apply to commercial companies that own domestic properties (such as large blocks of flats or even individual houses), do they require a register for each home or just certain areas within the flats.

Although the duty does not apply to domestic premises such as private houses, it does apply to the ‘common parts’ of multi-occupancy domestic premises, such as purpose-built flats or houses that are converted into flats.

This is where the regulations get confusing.

You need an asbestos register for all communal areas, which includes the exterior, plant room, cellar etc. but you are not required to have one for the actual domestic flats. However as soon as any work is carried out on behalf of the landlord that may come across some there is a duty to identify it.

If the work is classed as construction work then the landlord should arrange a survey under CDM 2015. For all other work then it is the responsivity of the employer, who in reality will just ask the landlord.

It is for this reason a lot of housing associations has bitten the bullet and surveyed the whole building. Buildings constructed after 2000 should not contain any asbestos by law.
