Hi Everyone Ongoing discussions as to whether our in house H&S team can sift through Tier 1 yes/no health surveillance forms or whether this has to be done by a competent OH person.

Hi,
I don’t see why you cannot so long as there is a clear process for it and if someone answers yes I do have a heart condition then this is reviewed by a Competent OH person. However generally within our company the initial questionnaire is sent out by OH before any health surveillance takes place.

But what if this information contains personal confidential medical information??? Drink, smoking, drug habits, diseases, disabilities, allergies and family histories? Big NO from me, unless the questions are extremely / suitably vague.

The HSE initial screening questionnaire for HAV only requires a question asking if on any long term medication, and no other personal data other than name etc we already have data protection, GDPR policies in place for H&S to handle personal data so it is dealt with in that respect.
We would only potentially be doing be doing noise and HAV initial screening in house then passing any yes answers over to our occ health provider, mainly to keep costs down as we have approx 1000 staff

Who drafted the Teir 1 health surveillance form and where is the supporting policy
to this (especially a confidential policy for HR and HS and the employee).
As long as you follow HSE screening questionnaires and have a confidential policy for HR,HS and employee you are well within your rights to confirm that all questions have been answered with the correct information, legible and that any
conditions can be assessed and solved before become a problem and assist the Occ Dr.
I would expect the HR and HS to review all employee information 6 monthly health surveillance as required especially in high risk occupations and agency staff due to quick turnaround off employees or change in roles within an organisation.
It is a legal requirement for an employer to assess the risks, an employee to inform the employer of any conditions that would require
an individual risk assessment.
