To assist in our production lines we produce for our own use equipment which is unique and special to us which we couldn't buy over the counter. This equipment doesn't fall within the scope of the Supply of Machinery Regs as it's not a machine but through digging around the murky pond I still need to satisfy some elements where basic risk assessment doesn't seem sufficient and I have to satisfy the Essential Health & Safety Requirements annex to the regulations. My question is, am I correct in my thoughts so far and if so, does any one care to share a proforma which will help/guide me please. Thanks in advance.

If it's not a machine, it doesn't fall under the SMSR. However, it may be a machine, I am confused by your post. Is it powered say by electricity? Does it have moving parts?

I'm thinking trolleys for moving parts around on. They would be pushed/pulled as you'd expect, so yes it has moving parts but they're not driven parts.

Manually powered equipment does not come under the scope of the machinery directive. Check here: http://www.hse.gov.uk/work-equipment-machinery/machinery-directive-definition.htm
First bullet point. For example, a lawn mower which is pushed by the user and the blades are then driven by the wheels as they roll when pushed is not machinery under the MD. If the lawn mower is pushed around by the user, but, the blades are driven by electricity or an engine, it is machinery.

So what you're saying is that I only have to risk assess and not use the EHSR's.

While you may not need to comply with EHSR dont forget to make sure you complu with the Provision and Use of Work Equipment Regulations and Section 7 HASAW.
