I understand the HSE use an Enforcement management model(EMM) which is essentially a flow chart that allows them to decide what level of penalty you will get (from verbal warning to prosecution). Do local authorities use the same document or do they have a separate EMM when considering how to progress a breach of H&S

Yes. They are expected to use the same model although it does not necessarily provide the absolute enforcement decision. It is a framework to drive consistency but context of the situation and other external factors may influence local outcomes.

At the heart of it is a risk gap analysis between actual and benchmark risk which is the principle driving factor in determining likely enforcement action - so somewhat more than just a flowchart.
