Hi

I've recently started working for a large multi-site organiation and am reviewing the Legionella Policy. Within this, they have noted that the statutory duty holder is the organisation and site leaders are the responsible person for each site.

I agree the responsible person is thr site leader but I have never seen the organisation documented as the duty holder. I have always thought the duty holder is the CEO of the organisation, rather than the organisation itself. 

Has anyone else come across this?

Contrary to what many people think, legionella does have its own set of regulations. The management of legionella comes under COSHH and in COSHH the duty holder is the employer ( organisation) rather than an individual.

Adding to what AK has said.....

I think you could delete the word "legionella" and still ask the same question.

Suppose you work for ABC Ltd with 100 UK based staff.

Section 2 of HSWA sets out lots of duties on "the employer" including to have a health and policy statement.

You might reasonably expect the CEO to give their imprimatur to the policy statement, e.g. by signing it, but would you expect it to be the CEO's policy rather than that of ABC Ltd?
