One of my department had an accident last year while he was driving his company car on company business, a lorry driver fell asleep at the wheel clipped my collegues car and it spun off the road; he has had two operations as a result and has been off work on SSP only for six months, the company stopped his salary very quickly. Most of the company personell travel vast distances by car as part of their role. my question is, is this a workplace accident? What recourse does he have? How does the comapny stand legally? If he made a claim would it affect any insurance payout? He is in dire finacial need and is concidering selling his house to live.

I trust that you have assisted him in getting his claim lodged against the employers of the lorry driver or his own insurers if self employed. We need to stop jumping to deciding whether RTAs are work related or not particularly in cases like this. If not already done please ensure the best possible legal advice and then the loss of earnings problem can start to be tackled
