Posted By Robert Woods Guidance please on facilities for eating in the workplace. WHSW regulation 25 (5) says Suitable and sufficient facilities shall be provided for persons at work to eat meals where meals are regularly eaten in the workplace. It goes onto state: 232) Seats in work areas can be counted as eating facilities provided they are in a sufficiently clean place and there is a suitable surface on which to place food. Should people be expected to eat their meals at their desks surely it’s not hygienic, which is contrary to: 233) Eating facilities should be kept clean to a suitable hygiene standard. Is the answer to splash mayonnaise and coffee over a few important documents?

Posted By Richard While I am sure many of us eat at our desks from choice, I would not have thought that this would be regarded as complying with the regulations if it was the only option available Richard

Posted By Mark Large My understanding is that a desk in an clean office meets the requirements. However a desk on the factory floor or in a lab with dust, airborne materials, biological hazards etc. is not.

Posted By Ken Taylor The three 'test criteria' within the WHS&W Regs where 'meals are regularly eaten in the workplace' seem to be: non-contamination of food; suitability; and sufficiency. Presumably an employer who decides that meals will not be regularly eaten within his/her workplace would not be required to make any provision under these Regulations. The results of any test cases of desk-eaters would be of interest.
