Posted By Bernie Woods Does anyone have any examples of case law specifically relating to supervision as required under S. 2(2)(c) of the Act. If not, is anyone aware of an HSE definition. I've got examples of companies being found guilty in this area but none seem to go into the specific failings in relation to supervision. Thanks

Posted By Robert K Lewis In raw terms supervision is that which the employer provides so as plan organise and control, including monitoring of performance, work undertaken by an employee. Thus section 2.2(c)refers to an (in)adequacy in these kay functions. It may be that the company has too large and employee:supervision ratio, the supervisors are inadequately trained or they are not supported in their work or they fail to perform their task adequately with the knowledge of more senior supervision. I believe that the term is so broad that the HSE would regard managers also as part of the supervision structure. Bob
