As you will be aware when completing RIDDOR forms we are required to disclose details such as name, address, age, sex, phone numbers of any person suffering an injury etc etc.

Where do employers stand with regard to disclosure of this information to what is a third-party (HSE) without the persons consent and is this in contravention of the Data Protection Act??

Any views?

No, because notification is a statutory duty. The problem is really the notification of others, especially safety reps. There is a direct conflict here with the Data Protection Act which the Commissioner failed to spot. Now the HSE is trying to figure out what to do about it. Evidently the law will need changing to sort this out.

We are also finding clients asking for this info., or their planning supervisor, and we now make edited details available but not the tel. line ref number.
We remove
Name, Address, Sex, and any other information which might identify the person.

As Allan says the statutory duty to notify has to be followed and I believe that the ivil servants involved have all been classed as Data Controllers for this purpose.
