My query relates to a disagreement between a landlord and tenant. Lease states 'no smoking' yet the tenant smokes. To my understanding this is a breach of contract and between landlord and tenant with whatever penalties apply in the agreement for breaches. The landlord has stated that the HSE will come and fine the tenant £20,000. Whilst I know the HSE can inspect, fine etc I didn't believe that would be the case for a disagreement of this nature. Any offers on this subject? Oh and yes smoking is an emotive subject but I have no wish to start a pro/anti smoking thread - grins.

HSE enforce Health and safety "AT WORK" the landlords talking nonsense.
