Seeking your views.

We have just had an "incident" where a production operator lost the plot with a machine which he punched after it had broken down.

The situation looks to be that he may have sustained fracture(s) to some of the bones in his hand - incident was witnessed.

The first aider did her bit then sent him to hospital where he is currently awaiting treatment.

I've had the first aider log the incident in the accident report book as a "self inflicted" injury. I will also conduct an "accident" investigation and raise a report.

The question on which I seek your advice/opinions is -

If his injury results in him being off work for more than three days, is it RIDDOR reportable under the three day rule? (bearing in mind that the injury was not directly caused by the machine failure and probably could not, justifibly in my opinion, be held against the company).

How about it, good people, what do you think?

Yes send RIDDOR, then investigate (both how he damaged himself, and why) and interview.
Once you're satisfied (or not)with operational safety aspect of the equipment,handling etc conclude your report and refer the situation to HR or senior management.
Your company will not be "blacklisted " etc, but will have properly reported an injury at work of which there will be a record

RIDDOR? Don't be daft! How does that injury arise out of or in connection with work?
Read the excellent SHP article on daft 'accidents'.
Your investigation should I suggest focus on identifying the workplace psychosocial stressors that may have led to such behaviour!(A touch of the Basil Fawlty?)

If there is a confirmed fracture to the persons hand (not fingers) then it is reportable .
If the person is admitted to hospital for more that 24 hours this is reportable.
If the person returns to work and is unable to carry out his/her normal duties for more than three days this is reportable.

Thanks for your responses which have confirmed what I was begining to think was the correct way to go, especially as I have since discovered there may have been a bit of "needle" from another person, connected with loss of production from the machine, which could be a contributory factor.

Stress in the workplace, peer pressure, bullying - sometimes makes you wonder what makes people tick doesn't it!
