Posted By John Calderbank Hi Just a question, this is in light of the consultant being fined with regards to a risk assessment (not suitable and sufficient i think it was) My friend has asked me to do some risk assessments for his business (hotel+golf club) where do i stand legally, my background for competency is ok i think, Risk assessment trained Manual handling assessor and train the trainer COSHH assessor All done through the company for my work where i am conducting risk assessments and developing safe systems of work, training out those systems also Qualification wise I've also got my NEBOSH certificate and part 1 and i am MIIRSM and TechSP. But i wanted to know what if someone was injured and I'd missed something where would i stand Thanks

Posted By Neil Pearson As I understand it you'll only be at risk of prosecution yourself if you're negligent, which in theory is not the same as simply making a mistake. It's the client's duty to employ a competent person, but I would think that your qualification level should be good enough. A separate worry is your civil liability. Do you carry professional indemnity insurance? You should if you would be self-employed for this job. Whether you are being paid or doing someone a favour is irrelevant.
