Posted By johnwaterson If wheel chairs are supplied by a housing executive for the disabled are they responsible for the up keep of wheelchairs. I would have said yes but if anyone can clarify, many thanks.

Or are they being supplied to an individual for their long-term use.Either way, the exec., is responsible for their upkeep, (duty of a 'Hirer' - duty of care etc). However, dependant upon the arrangement, the exec., might also have to consider "fit for purpose", i.e. is the wheelchair suitable to meet the disabled person's particular needs.The wheelchair may need to be 'fitted' to an individual. Posted By Ken Taylor Whilst they will have a duty to supply something that is safe, it will depend upon the definition of 'supply' and contractural arrangements made in this regard as to whether there will be an ongoing duty to maintain them in a safe condition. They would be well advised to clarify this within the hire, lease, purchase, gift or whatever paperwork at the time of supply and obtain recipients signatures thereto.
