Posted By Tom Phillips Hoping someone can advise as I am having a long running debate with a colleague as to when permits to work are required.
My stance is that there is no specific requirement in indvididual legislation demanding a permit to work (have checked electrical live working and confined spaces) and that a permit to work should be used as part of a safe system of work to control forseeable hazards.
Our internal policy on permits to work defines specific activities where permits to work are a legal requirement. This allows our contractors and staff to wiggle out of using a permit for such things as working on roofs etc. I am advocating a less prescriptive approach to cover any work where there is significant forseeable risk.
Is there anything prescriptive that anyone can advise? Or am I taking the right approach?

You will find it difficult to find any prescriptive legislation regarding this as the HSE/HSC have moved away from prescriptive legislation to a risk assessment based approach and it is now therefore the responsibility of employers to conduct risk assessments to decide what suitable control measures are required to reduce the level of risk to as low as is reasonably practicable. There are certain activities that I would hope most employers would only conduct or allow to be conducted i.e by contractors, under a permit to work system; working at heights, entry into confined spaces, hot work, electrical/mechanical isolation of plant/equipment, excavation and any other activity that when assessed is deemed to require a permit to work issuing as an additional control measure before starting that activity.
Permit to work systems are considered an essential part of any health and safety risk management process. Remember Tom that compliance with the law is the minimum requirement and we should always aim higher and seek continuous improvement.

I agree with Clarke's comments above. I would also suggest Demolition Works and Asbestos Removal Works are a given without Risk Assessment.
