Posted By Neil Tonge It was removed from MHSWR and Fire precautions workplace regs. They can now be sited as breach of statutory duty in a civil claim. HASAWA can not be cited due to its breadth. Hope this helps, Neil

Posted By Chas It is worth remembering that the exclusion still applies to non employees, ie only an employee can cite the regs (MHSW and FPW Regs) in civil proceedings.
