Posted By Michael Jones This is probably a bit basic, but what are the rules around the recording of accidents in an accident book? Can we force an employee to record an accident or does the employee have a choice not to do so? Conversly if management think an incident is not an accident can management refuse to record it in the accident book?

All injuries from accidents must be recorded in your accident book. No choice!
I am trying to think of circumstances where management would not wish to make a record. If you suspect someone will make a dubious claim it is more essential to ensure all the facts are recorded. It would not look good in court if your company did not allow an entry in the accident book, as it would appear you have something to hide.

Duty of employees Section 7.b of HASAWA - As regards any duty or requirement imposed on his employer by or under any of the statute legislation, to co-operate with him so far as is necessary to enable that duty or requirement to be performed or complied with.
Keeping an accident book and records is required under Social Security Regs. Therefore an employer has to do this and therefore an employee has to co-operate.
