Posted By PaulA Does anybody have or know of information relevant to legislation relating to a car breakers yard (scrap yard..) that employs 3 people. The owner has no formal H&S awareness and owns a four acre site. Obvious environmental issues are about to bite his proverbial but thats another issue on its own. No accidents have happened in its 40 years it owner tells me but he appreciates that "one's due to happen!" Any information relevant to this would be appreciated. Regards Paul.

Just tell him to be very carefull just for a little while longer, The End of Vehicle Life Directive will do the rest!!!!!!! He says that he has not had an accident in 40 years but would he know what to do if he had one? Ask him where his accident book is!

Posted By Dave Daniel The answer is that all the "usual" H&S applies (HAWASA, LOLER, PUWER, Noise, COSHH etc etc.) although with only 3 he doesn't have to record much... although his insurers might need to see something recorded before they even consider insuring him.
He'll need to give particular attention to visitors and their activities and recovery/transport operations.
The End of Life Directive will bite hard although I understand the high price of scrap has encouraged smalll operators to keep going

Posted By george guy hi PaulA i am a company H,S & E adviser within the vehicle dismantling business, we employ over 100 persons over 5 sites in and around yorkshire. i must admit that your thread is not very surprising. with regards to never having an accident he probably means he never had one reported to him, due to the nature of the work accidents are a common occurence in this sector. the following help is at hand: try the Motor Vehivcle Dismantlers Association (MVDA)they have produced a h&s handbook that is useful, and try the Health & Safety Executive Website they have a section under Motor Vehicle Repair that has lots of useful info. environmental ELV directive: this has already come into effect and if he hasn't achieved Approved Treatment Facility (ATF) status yet then he must do so to carry on processing vehicles. if you require further advise you may contact me via email on george@doncastermotorspares.co.uk george

Not H&S legislation but criminal legislation the operator is required to be registered with the local authority under the Vehicle Crimes Act 2001 - The Motor Salvage Operators Regulations 2002. There is also a specified police check in that the person is 'fit and proper' for the registration.

I can see that legislation is obviously changing rapidley in this direction and that he has some big decisions to make on his investment in H&S should he wish to keep operating
