Posted By Simon Berry Can anyone assist with supplying information (prefably case law) when disciplinary action, even dismissal has been used against an employee that constantly has accidents despit repeated training and close supervision.

Posted By Jason Touraine Any discipline should be for breach of h&s requirements not having accidents! And then only if the employer has established effective systems. The repeated accidents may be because the training and supervision are not adequate. And training is not a substitute for proper control measures; see the hierarchy in the MHSW Regs.
