When I researched it, I found it had been tested in court (Europe I think). The test case involved doctors working at a hospital but I imagine it would apply equally in any profession. The judgement as I recall was: If the on call time is spent at the workplace, then this is classed as working time, even if the person(s) on call are able to rest and even sleep. If however, the on call time is spent at any other place, but the person may get a phone call to come in, then this is not classed as working time. To clarify further; it the people on call have to be where their employer dictates, this is working time. If they can be at home or anywhere else, it is not working time. Best wishes.
