Posted By Kay Fuller I have been asked to find a speaker for our Health and Safety Committee to present on the working time directive. The group are particularly interested in how 'on-call' time is accounted for by the directive. I am looking for someone to talk for 30-60 minutes, who is capable of fielding direct and challenging questions and able to give practical examples of how the working time directive plays out in 'real life'. Can anyone recommend a speaker or an organisation I can contact to request one? I'm based in Gloucester. Thanks in advance Kay

Posted By Bev Hi Kay, Sorry I don't know of any speakers. But the on call question is one which I have come up against in the past. When I researched it, I found it had been tested in court (Europe I think). The test case involved doctors working at a hospital but I imagine it would apply equally in any profession. The judgement as I recall was: If the on call time is spent at the workplace, then this is classed as working time, even if the person(s) on call are able to rest and even sleep. If however, the on call time is spent at any other place, but the person may get a phone call to come in, then this is not classed as working time. To clarify further; it the people on call have to be where their employer dictates, this is working time. If they can be at home or anywhere else, it is not working time. Best wishes.
