I always considered that all demolition or dismantling work of whatever duration was covered by all the CDM regulations. Therefore there would be a duty to notify, appoint a planning supervisor, a principal contractor, create a H&S plan etc.
I have just phoned the HSE who have told me otherwise. Who says CDM is confusing?
Is it just that there is no need to notify if the work is not of the prescribed duration?
If there are any CDM experts out there who can help me I will be forever indebted.

Demoliton and dismantling is always notifiable under CDM to the HSE because of the higher risks involved.
However to come under full CDM regulations the duration criteria must be met. Hence whilst you always notify, you do not always have to go down the PS and H and S plan route. It is a good idea to have one, or at least a minimum of a good risk assesment and method statement.
That's my take on it.

John is wrong. You only need to notify when the criteria set out in reg. 7 is met. You can confirm this with the local HSE office (make sure you ask for the construction section and ask to speak to the local inspector – not one of the clerks).

Oops, quite right, I got it the wrong way round, according to the ACOP all CDM regulations apply but the project only needs notifying if the reg 7 thresholds are exceeded

The principal contractor can take on the duty as planning supervisor and the designer which is what really happens on smaller projects. We decommission petrol stations, remove forecourt canopies and underground storage tanks, we always work under CDM and in some circumstances we do have a planning supervisor who is appointed by the client, but not always. As for notification it is good practice to Notify local HSE on F10 if your programe of works is 3 weeks long as you could creep towards the 30days or 500 person shifts (Days) before you know it.
