Posted By Simon Carrier Good afternoon I am looking for some information on supplying second hand work equipment. Basically we have a piece of equipment known as a Beanstalk that enables people to sit on a seat and be lifted about 20/30 feet. This has been inspected by a competent person who has "condemned" it because it does not have a hand rail. We have been approached by a former employee who is willing to take it off our hands and use it to change spotlight bulbs at his cricket club. Questions Should we let him take it in its current condition or ensure it has the handrail fitted prior to it going? Does PUWER apply? Any other advice would be appreciated. regards

Posted By Paul Adams You should only let it go in it's current condition on the clear (documented) understanding that it is not fit for purpose and is being sold (or given away) as scrap.
