Posted By Peter Warrington I'm currently working on some additional clauses to add to a GC Works type contract. Has anybody added some health, safety and environmental clauses before and have they worked in improving performance? Please can you tell me what you did and whether it worked in practice?

Posted By ken mosley Whatever you do by adulterating any contract conditions you must not lose sight of the basic premise " You cannot contract out of the law". There are countless examples of Clients, PQSs acting as planning supervisors and designers trying to use contract, pre-tender plans, preambles to BQs, special conditions and specs in attempts to transfer CDM liabilities to the PC. Despite the legislation not allowing such practice, it doesn't stop them doing it.
