My company, this morning, received a citation from the police to attend court for a breach of the COSHH Regs relating to Occ Health. Whilst we were aware that the matter was being referred to the Procurator Fiscal [Scotland] our court appearance is scheduled for Friday of this week.
Does anyone have any idea whether there is a minimum time period between citation and appearance? The options given were
1. A personal attendance from the site manager
2. The attendance of a lawyer
3. A letter delivered 2 days (sic) before the case is called.

I'm not an expert on Scottish law. There has been a postal trial for delivery of witness summonses going on in Scotland which may be relevant - see here http://www.scotland.gov..../kd01/green/postal04.htm
This gives the impression that the summons is supposed to be delivered 6 weeks before the trial.
I would ring the court ASAP and explain that you've only just received the summons.
Of course if you're going to plead guilty and your mitigation case is already prepared then you might just want to go ahead.
This is probably not the best place to discuss the details....

The case is unlikely to be heard on Friday, you can either:
(a) plead guilty without a lawyer and hope for a very small fine;
(b) go with your lawyer who will ask for further particulars before you can plead
Sometimes they are quick off the mark.
