Does LEV carrying wood dust to a bag require statutory inspection? I think it does the powers that be disagree.

You don't identify who the "powers that be" are but I suspect that they're your employers representatives. Just get them to consider how they would defend their view in the face of an enforcement action under CoSHH and PUWER.

Presuming you're talking about senior management at your company :-)
All LEV requires the 14 monthly inspection by law.
We have to have plastic grinding machine LEV (which only removes the dust to a bag) tested so it will be no different.

What is & isn't LEV can often be a matter of debate.
I have had clients who thought that cooker extracts were LEV or that process vents from sealed reaction vessels were LEV!
A simple way to approach it is
1. Is the substance being extracted hazardous by inhalation?
2. Is it possible that an operative can be exposed by inhalation if extract doesnt work?
If the answer to above is YES then it probably is LEV....
Remember that LEV test intervals may be more frequent than 14 monthly depending on the hazardous substance extracted.
