Is working in a tower crane classed as working at height? I know access to it is, but it's not a permanent structure.
What about police and ambulance staff in helicopters?

A place is at height if a person could be injured falling from it - according to indg 401 from the HSE.
So if you can't fall from the crane (once you're in it I presume this isn't possible) then it isn't.
If you can't fall from a helicopter then this isn't either. I should think BAA, Ryanair etc are all relieved about this - think of all their stewards/esses & pilots!
