Very grateful for folks thoughts on the following CDM senario:
following a fire, premises require complete re-build. WOrkis fairly major so CDM applies.
Insurance company are instructing builders & paying costs, but owner of property insists on approving every element of materials used, construction techniques etc.
The question is, in CDM terms, who is the client ?

From experience the insurance company generally acts as the Client, but as you have a helpful duty holder prehaps this alters the resposibilities. I would be having a meeting with all involved and establishing this. Stating the resposiblities of each and see how they respond.
The designer should be able to establish the types of materials being used in the project befor the construction phase, this could be done with the assisstance of the duty holder, therefore they know what is going on site ect.

The Client is the person who (amongst other things) appoints the Principal Contractor.
Sounds like the 'owner' is dabbling in design and needs to be aware of designer duties.
Client also needs to urgently remedy any situation where the PC may be receiving conflicting instructions from the Client (CDM) and the client (with a small 'c').

Client = insurer, however as the occupier appears to be directing / specifying etc he is taking on the liability as Designer, and may well be working outside the remit of the client - the insurance company in terms of cost.
Would get a meeting with all parties, ensuring a strong lead from the true client to make it clear who is the Client, Designer, PC etc
and the limits of each
