Indian Health, Safety & Environmental Legislation

Hi Folks
A colleague and myself are having to deliver a presentation based on our own health, safety and environmental management systems to a representative from an Indian manufacturing company and I would like to be able to draw some comparisons.
I have undertaken a bit of investigation and I believe most of the Indian legislation in based around The Factories Act.
Has anyone any direct experience of working in India who can perhaps direct me to more detailed information?

If you go to the IOSH International Specialist Group web site (go to specialist groups then International then Links then Asia Pacific) you will find some of the Indian legislation.

The results of your research would be interesting to see. The link on my previous posting is a useful starting point to traverse your way through a substantial amount of India’s labour laws (follow the links on the side bar). In addition the DGFASLI have a series of on-going research programs aimed at improving safety, inspections and training throughout the country. A summary can be read at: http://dgfasli.nic.in/research1.htm .
The Factories Act, 1948 contains this very familiar duty: “Every occupier shall ensure, so far as is reasonably practicable, the health, safety and welfare of all workers while they are at work in the factory”,
The Dock Workers Safety, Health & Welfare Act 1986 details all the safety measures familiar in many different UK regulations and the following range of acts cover many other areas of OSH & Environment issues,
· Environmental Protection Act
· Manufacture, Storage and Import of Hazardous Chemical (Amendment) Rules, 2000
· Building & Other Construction Act
· Mines Safety Act
· Indian Boilers Act 1923
· Indian Boilers Regulations
· Dangerous Machines (Regulations) Act
· Child Labour (Prohibition and Regulations) Act
· Indian Electricity Act
· Indian Electricity Rules
· Indian Explosives Act
· The Petroleum Act
· Static and Mobile Pressure Vessels Rules
Not exactly a dearth of safety legislation. Hope this information is useful

India is a country of extremes--where you will find the best in the world existing side by side with some of the worst. This is not only in context of business enterprises, but also incomes & wealth. Be prepared for a culture shock.
There is no dearth of legislation, although there is no equivalent of HASAWA. Consequently, some sectors are not fully covered. There is also employment legislation that covers some aspects of welfare requirements for offices/shops etc. In India, enforcement of its factories act and environmenatl legislation is not at central government level, but at state level. Enforcement can be lax--many a time, the Supreme Court of India, especially in context of environmental protection has had to "force" the central & state governments to enforce the law!! (through public interest litigation)
Also, the "organised sector" (i.e factories where trade unions exist) is reasonably well protected-- but the unorganised sector has huge safety issues
There is a proposal to have an over-arching health and safety act that protects all workers.
Since you have mentioned Bangalore, I presume that you are referring to IT based hardware or software industry.
