Posted By Jane Watts Can anyone give me any advice on how a company stands with regards to sponsoring its employees (teams) to take part in an organised sports/mental challenge. I'm not sure whether they individuals will be taking the time off to participate as leave, or whether they company will allow them time off. The company has nothing to do with the running/organisation of the event but is financially sponsoring some employees to participate as a team. Any advice would be welcome!

Posted By mike.mcdonnell Tricky one this, if your organisation has any involvement in relation to the employees contract of employmnet it would be prudent to consider undertaking a risk assessment. The nearest in terms of advice I have come across in relation to this type of activity is the HSE Publication 'Safety at Charitable Events' ( if my memory serves me well). I work for the Co-op (tCG) and our employees, members and customers often are involved in this type of activity and we have produced a simple RA pro-forma, give me a ring / e mail, if you would like a copy. Posted By Fred Pratley As I understand your post, your company has no input into the event, and is therefore making a donation to the organising body or charity that it is supporting. I do not see a "liability" question arises, but it is still in the company's own best interest to ensure it will still have fit and health employees back to work the next day! Regards Fred

If employees percieve themselves as standing to profit in a material sense or improved standing in the company, then the company may be open to litigation should an accident occur, as it may be percieved as a 'duty'. You would be well advised to check on the systems set up by the event organiser in these circumstances. 2. If the team is using the company name/logo, then once again this could be construed as the company profiting and thus there is a duty to ensure all is well regarding the event safety. Good luck to the staff, and here's hoping they do well for whatever charity they are striving for. Richie.

Posted By Jane Watts Thanks all, i've just confirmed that the guys are using their own time, which narrows it down a bit. I did think about contacting the organising body. I've had a look on their website and they advertise themselves as the 'worlds leading organisers of inter-business team building competitions' I would imagine the company name will be featured as we're up against other companies. The companies involvement so far is sponsoring the guys (I think) to ge them to the finals.

Posted By Fred Pratley I would take the web site description as "team building competitions" to mean that your business is funding employees to go on a training course. As such you have a duty of care, and I don't think it matters whose time they are on. Good luck. Fred
