Posted By Charlotte Snow Dear All I must admit to being somewhat confused here, as to when this order comes into force. Article 1(2) say this and article 52(1)(a) come into force the day after the order was made, and the remaining provisions on the 1st April 2006 - Article 1(3) . When reading article 52(1)(a) this refers back to Article 1(3).....Does this mean the whole order is then effective 1st April 2006 , or have I missed something and some bits are valid now. Confused or what! Can anyone advise me please , I would be very grateful best wishes Charlotte

Posted By Heather Collins Charlotte Most of it comes into force next April. Only Clause 1 - the bit that names the Order and gives the various dates, and the later clause that says clause 1(3) is to be considered a "subordinate provision" of the Regulatory reform Act 2001 (I have not looked up what this means mind you - but I don't think it has any bearing on the effective date) are in force now. Posted By Frank Hallett Hi Charlotte & Heather. You have identified a typically British ODPM [ex Home Office] way of mangling [not managing] a good logical process. What it all means is that the RRFSO is now law but it will not become active until April 2006. The apparent intent is to enable Britain & Wales to become sufficiently familiar with it's requirements before the actualstart date to minimise the usual cries of "But I didn't know". I don't believe for one minute that it will succeed in that aim as most of those who really need to know don't really understand how the current FP[W] Regs affects them and will have forgotten or overlooked the incoming RRFSO long before April 2006. Posted By Gary Seekins Yes the legislation is due to become active from April 2006. The only caveat to this is if the some of the guidance documents are not ready then there will be delay in implementation. The guidance documents are being written by BRE the deadline for completion is January 2006. Gary
