To all housing associations

If a property (under these new regs, a site)becomes void or any hazardous waste (asbestos, fridges, flourescent tubes PC's) needs removing for disposal
e.g. normal 3 bedroom house, but could be any living accomodation or other property a company is responsible for.

I believe before removing the hazardous waste the association would have to register the property (min cost £18 / max.cost £28) with the EA.

I do not think you need to register the site before the 16.07.05 because you would not know when the property becomes void (and needs to be cleared ready for the next tenant) or requires the hazardous waste to be removed.

So if you have thousands of properties which some associations do have be prepared to give to the EA a very lot of money in the future.

This does not take into account new increases in landfill tax. (back door tax)

Are these new Regs necessary?
What was wrong with the Special Waste Regs?

More absurd regulations that are incredibly difficult to understand and even more difficult to simplify for management.

I believe after the 16.07.05 most waste will have to be seperated to determine which is hazardous and which is not, building / demolition sites spring to mind.

Why does the UK gold plate every piece of legislation, then enforce it to the letter?

I think I am right in stating when new legislation comes from the EU member states do not have to accept it, but can adapt it to their own requirements like other EU states do

Any views on this or other legisaltion that does not work and costs a fortune to adhere to

Sorry, forgot to mention the 200kg limit. A site may be exempt if it produces less than this amount a year.

I have just done a brief on this for our directors and managers

Domestic premises are exempt from registration however contractors removing hazardous waste from them are not. Even with exempt premises they still require a Haz Waste Consignment Note!

Within the premise notification guide and in conjunction with the consignment note process there is scope to enter exempt premises in the premises box also for flytipped Haz Waste as well.

Mobile producers can also use their code for this as well

There is much info been produced by the EA in the past 72 hours on this. go to www.environment-agency.gov.uk.

If you are doing major refurb work for a large social housing project then the project as a whole may need registering as one site but not individual properties.

PS if disposing of HAZ Waste from one premise and the total weight is under 200kg in any one year, then no requirement to register.


The year starts from the date of registering or removal!
