Posted By Ian Bruce I hope that colleagues may be able to help with this question I've had from a work mate that I was unable to answer! Is there a piece of H&S legislation that prevents development of land for recreational use around a chemical manufacturer/supplier of light industrial chemicals? This is basic stuff, bleaches, acids, alkalis etc. I could'nt think of anything apart from of course those concerns regarding flammables and explosives. I'll be grateful for any advice received as the work mate is my boss! I've had a trawl through the info I have, but I've drawn a blank.

Posted By peter gotch Ian, Might be a "major hazard" site subject to COMAH Regs. If so HSE would be a statutory consultee for any planning applications. See the major hazards pages on HSE website. Regards, Peter

Posted By MichaelM Could also be in the building regs. You Local Authority may be able to help. Could be something that the local Envoronmental Health Department may also know about.

Posted By IanD Hi Ian I susspect what is being quoted is the restrictions placed on developing land surrounding a Top Tier COMAH site. These restrictions are regulated by the Town and County Planning (COMAH) Regulations 1999 or 2000 ?. This limits the scope of the development to low rise, low occupany developments; car parks, single storey shops etc . Regards Ian

Posted By JEFFREY SMITH hmm I am not sure what your colleague is suggesting. Surely no-one would be daft enough to actually want to build a recreation site for kids next to a chemical factory? A good question for your colleague is to find out why he/she is asking and then go from there? I should imagine there is something somewhere (particularly after the disaster in the 80s in India...). Your local council would be a good starting point + public pressure is also a good aid to disuading silly ideas like this.
