Dear all,
As I type this message I am in the process of conducting a health and safety compliance audit at a manufacturing company in South Korea. It is basically a gap analysis against their own legislation and UK legislation. I was supprised to find that if a company falls under a certain critera, one being employing more that 50 full time employees then the company must have a twice monthly health and safety inspection and a once monthly occupational health inspection by a competent person trained by the Korean Government. This can be an employee, but it is usually outsoursed. The inspections follow a generic list based on the regulations and the completed inspection tasks improvements and responsibilites. A copy of the completed form is also sent to the regulators, Korean ministry of labour. Seems to be quite an effective system that its working well. the particular site I am at has not had a serious, reportable accident since 1999. Just think of all the work the UK health and safety practitioners would get if the same system was followed in the UK. Mind you there are some areas of weakness suchas the prescriptive legislation, which has no risk assessment concept.

Article 5 of the Industrial Safety & Health Act requires all employers, amongst other duties, to “safeguard the lives and maintain and promote the safety and health of employees by creating proper working environment through the improvement of working conditions”. Risk assessment is a tool to assist in determining what control measures that may be required in the workplace and as such may be used in any workplace, under any jurisdiction, regardless of whether or not the safety legislation mentions it. Its use as a tool is therefore not incompatible with the requirements of Article 5.
The other points you mention, very interesting. It goes to show that there is a lot out there that we could all learn from.
